Supersedeas bond was required as condition of stay pending appeal of order approving settlement agreement.

The codefendants of a Chapter 7 debtor in the trustee’s adversary proceeding did not satisfy their burden of showing that a supersedeas bond was not required in connection with a stay pending their appeal of the bankruptcy court’s order approving a settlement agreement between the debtor and trustee in the proceeding. Therefore, the posting of a bond was required as a condition of a stay pending appeal. The codefendants acknowledged that a stay would delay the implementation of the settlement agreement, which contemplated future transactions and proceedings involving a limited partnership in which the debtor had held an interest and real property owned by the partnership at petition filing. The trustee identified realistic potential harms to the bankruptcy estate that could result from the delay, and the codefendants did not show any exceptional circumstances warranting a waiver of the bond requirement.
